We respect your privacy and are committed to protecting it by complying with this privacy policy (“Policy”).  This Policy describes the types of information we may collect from you or that you may provide (“Personal Information”) on the tailgators.ca website (“Website” or “Service”), including when you make a reservation, book a group event, or contact us, and our practices for collecting, using, maintaining, protecting, and disclosing that Personal Information.  It also describes the choices available to you regarding our use of your Personal Information and how you can access and update it.

This Policy is a legally binding agreement between you (“User”, “you” or “your”) and TailGators (“we”, “us” or “our”).  By accessing and using the Website and submitting information through our forms, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy.  This Policy does not apply to the practices of companies or individuals that we do not own, control, or employ.

 

Automatic collection of information

When you open the Website, our servers automatically record information that your browser sends.  This data may include your device’s IP address, browser type and version, operating system, language preferences, the page you were visiting before you came to the Website, pages you visit, time spent on those pages, information you search for on the Website, and access times and dates.

This information is used only to identify potential cases of abuse and to establish statistical information regarding the usage and traffic of the Website.  This statistical information is not aggregated in a way that would identify any particular User.

Information collected through our forms

TailGators collects Personal Information you voluntarily provide when you use the forms on our Website, including:

– Contact Us form: your name, email address, and message
– Group Party Reservation requests: your name, email, phone number, event type, expected number of guests, event date and time, and event details
– Table Reservation requests: your contact details and table preference

We use this information solely to respond to your inquiry, confirm and manage your reservation or event booking, and communicate with you about your request.  We do not use information submitted through these forms for unsolicited marketing without your consent, and we do not sell this information to third parties.

Privacy of children

We do not knowingly collect any Personal Information from children under the age of 18.  If you are under the age of 18, please do not submit any Personal Information through the Website. If you have reason to believe that a child under the age of 18 has provided Personal Information to us through the Website, please contact us to request that we delete that child’s Personal Information from our records.

We encourage parents and legal guardians to monitor their children’s internet usage and to instruct their children never to provide Personal Information through the Website without their permission.

Please note: this section addresses the collection of personal data online and is separate from TailGators’ age of majority requirements for alcohol service, which are governed by our Terms & Conditions and applicable Ontario law.

Use and processing of collected information

In order to make the Website available to you, respond to your inquiries, and process reservations or event bookings, we need to collect and use certain Personal Information.  If you do not provide the requested information, we may not be able to fulfill your request.

We use the information we collect for the following purposes:

– Respond to inquiries and offer support
– Process and confirm reservations and group event bookings
– Improve user experience on our Website
– Enforce our Terms & Conditions and this Policy
– Protect against fraud, abuse, and malicious activity
– Run and operate the Website

We only process your Personal Information where we have a valid reason to do so — such as your consent, the need to fulfill a reservation or request you’ve made, or a legal obligation.  We are happy to clarify the specific basis for processing upon request.

Cookies and tracking technologies

Our Website may use cookies and similar tracking technologies (such as web beacons) to support core site functionality and to gather standard analytics about how visitors use our site — such as which pages are visited, how long visitors stay, and general traffic patterns.  We may use third-party analytics tools (such as Google Analytics) for this purpose.

The information gathered through these tools is used to monitor and improve the performance of our Website and is not used to build individual profiles of identifiable Users.  You can control or disable cookies through your browser settings; note that disabling cookies may affect some site functionality.

Disclosure of information

We may share your information with service providers who help us operate the Website and fulfill reservations or event requests (for example, email or hosting providers), provided those providers agree to handle your information in accordance with this Policy.  We do not sell your Personal Information, and we do not share it with unaffiliated third parties for their own marketing purposes.

We may also disclose Personal Information if required by law — such as in response to a subpoena or similar legal process — or where we believe in good faith that disclosure is necessary to protect our rights, protect the safety of our guests or staff, investigate fraud, or respond to a lawful government request.

Retention of information

We retain your Personal Information only for as long as necessary to fulfill the purpose for which it was collected — such as completing a reservation or responding to your inquiry — or as required by law. Once that period has passed, your Personal Information is deleted or anonymized.

Do Not Track signals

Some browsers include a “Do Not Track” feature that signals to websites that you do not want your online activity tracked.  Because there is no uniform standard for how browsers communicate Do Not Track signals, our Website is not currently set up to respond to them. That said, as outlined throughout this Policy, we limit our collection and use of Personal Information to what is necessary to operate our Website and respond to your requests.

Social media features

Our Website may include social media features and links, such as buttons linking to our Facebook, Instagram, Twitter/X, Foursquare, and Yelp pages.  These features may collect your IP address and the page you’re visiting on our Website, and may set a cookie to function properly.  Your interactions with these features are governed by the privacy policy of the respective social media platform.

Our Website may contain links to other websites that are not owned or operated by us (for example, our pool league stats page or third-party booking tools).  We are not responsible for the privacy practices of these other sites.  We encourage you to review the privacy policy of any external site you visit.

Information security

We take reasonable administrative, technical, and physical measures to protect the Personal Information we collect from unauthorized access, use, or disclosure. However, no method of internet transmission is completely secure, and we cannot guarantee the absolute security of information transmitted to our Website.

Data breach

If we become aware that the security of our Website has been compromised or that Users’ Personal Information has been disclosed to unrelated third parties, we will take reasonably appropriate steps, including investigation and, where required, notification to affected individuals and cooperation with law enforcement or applicable regulators.

Changes and amendments

We may update this Policy from time to time. When we do, we will revise the "last updated" date at the bottom of this page. Your continued use of the Website after an updated Policy is posted constitutes your acceptance of the changes. We will not use your Personal Information in a materially different way than what was disclosed at the time it was collected, without your consent.
